Is killing a spouse and lover while committing sexual infidelity exempts one from criminal liability?
Any legal married person who having surprised his spouse in the act of committing sexual intercourse with another person, shall kill any of them or both of them in the act or immediately thereafter, or shall inflict upon them any serious physical injury, shall suffer the penalty of destierro.
In destierro there is no imprisonment but a prohibition on the accused to come close within the vicinity set by the court. This is to protect the accused from acts of reprisal principally by relatives of deceased.
If he shall inflict upon them physical injuries of any other kind, he shall be exempt from punishment.
